Below are our Terms & Conditions and Privacy Policy. These cover how appointments and events work, how we handle your info, and how reminders/updates (like email or text messages) are sent when you opt in.
Terms & Conditions
SMS Program Terms BrightMinds Photography may send you SMS messages related to your appointments, such as booking confirmations, reminders, and reschedule/cancellation updates. By providing your mobile number and selecting SMS reminders during booking, you consent to receive these messages. Message frequency: Varies based on your appointments. Message and data rates: Message & data rates may apply. Opt out: Reply STOP to cancel SMS messages at any time. Supported carriers: Supported carriers are not responsible for delayed or undelivered messages. Privacy: We do not sell your personal information. See our Privacy Policy for details. If you have questions, contact us at: contact@brightminds.media. 1. Booking & Deposits Silver Packages and Mini Sessions require a $50 non-refundable deposit at the time of booking. Gold Packages require a $70 non-refundable deposit. The remaining balance is due on or before the day of the appointment. We will not begin work on photo or video editing, delivery, or printing until the final balance is paid in full. Deposits are non-transferable and non-refundable except in the rare case of a cancellation initiated by Bright Minds Photography. 2. Late Arrivals & No-Shows Clients who arrive 10 minutes or more past their scheduled time without prior notice will be considered a no-show. No-shows and late arrivals forfeit their session and deposit. Clients who reach out before their session to communicate a delay may be rescheduled at Bright Minds’ discretion based on availability. 3. Payment Methods Payments are accepted through approved processors such as Square or other secure links provided by Bright Minds Photography. Payments must clear before any products, galleries, or downloads are released. 4. Session Rights & Delivery We reserve the right to withhold delivery of galleries, videos, or edited content until full payment has been received. Turnaround times vary depending on session type, editing requirements, and seasonal volume. Clients are responsible for verifying that their contact information is correct at the time of booking. 5. Prints & Digital Files Portrait and paid-session clients may purchase prints at lab cost directly through Bright Minds Photography. Directory photo participants are not required to purchase prints, though options are available. Clients who purchase digital files are granted full personal print rights and may request a Print Release Letter for outside labs. Purchased images do not include watermarks. Complimentary or school-use images (e.g., provided to band directors or teachers) may include a logo watermark. These files: May be used only for the intended school or organizational purpose, and Must not be altered, cropped, or have the watermark removed. 6. Copyright & Usage Rights All images, videos, and creative works remain the exclusive copyright of Bright Minds Photography and Bright Minds Studios, even after purchase. Clients receive a personal license to print, share, and display their purchased images for personal use only. Bright Minds retains the right to use select images for marketing, portfolio, promotional, or educational purposes unless the client requests otherwise in writing before the session. Social Media Use When posting images on social media, a visible Bright Minds logo or tag must be included. Exceptions: clients from portrait or event sessions (such as seniors, headshots, couples, weddings, quinceañeras, or corporate events) and paid parent purchases are not required to include a logo, though credit is appreciated. Complimentary photos provided for school staff, directors, or teachers may be watermark-free and can be shared freely for their intended purposes; however, copyright always remains with Bright Minds Photography. 7. Children’s Images & Privacy Bright Minds Photography understands the importance of child safety and privacy. Many of our clients are parents with children in schools or daycares, and we take these responsibilities seriously. We only post or share images of children that have been approved for release by authorized school or daycare faculty. Schools and organizations determine which images may be publicly shared based on the permissions granted by parents or guardians. We do not post, tag, or distribute identifiable photos of minors without verified consent from the appropriate party. Parents or guardians may contact us at any time to request that an image of their child be removed from any Bright Minds platforms. 8. Rescheduling & Cancellations Clients may request a reschedule by contacting Bright Minds Photography at least 48 hours in advance of their session. Rescheduling requests are subject to availability. Deposits will not be refunded but may be transferred to a new date one time only, with approval from Bright Minds Photography. 9. Use of Images by Bright Minds Bright Minds Photography reserves the right to use select images or video clips for marketing, portfolio, or promotional use unless the client opts out in writing before their session. Clients may request privacy for their images at any time by contacting us directly. 10. Liability Bright Minds Photography is not responsible for weather, client tardiness, technical issues, or other conditions beyond our control that may impact the session. In the event of equipment failure or unforeseen cancellation by Bright Minds Photography, liability is limited to a full refund of any amount paid. 11. Agreement By booking, paying a deposit, or participating in any session with Bright Minds Photography or Bright Minds Studios, you acknowledge that you have read, understood, and agree to these Terms & Conditions. This may include: Name and contact details (email address, phone number) Booking details and appointment preferences Directory or project submission details (e.g., family names for parish or school directories) Payment information (processed securely through Square) Order, proof, and gallery data (through Pixieset, PhotoDay, CloudSpot, or Miller’s Professional Imaging) Communication history and preferences Technical data such as IP address, browser type, and usage analytics 2. How We Collect Information We collect information in the following ways: Directly from you when you fill out a form, schedule a session, or communicate with us Through third-party platforms we use to operate our business (Acuity Scheduling, HubSpot, Square, Pixieset, etc.) Automatically through cookies or analytics tools that help improve website performance and user experience 3. How We Use Your Information Your information is used only for purposes directly related to delivering and improving our services, including: Managing appointments, sessions, and client communication Processing payments and fulfilling orders Sending appointment confirmations, reminders, and updates Delivering galleries, proofs, and order notifications Responding to inquiries and providing customer support Creating and distributing community or organizational directories (such as parish or school photo directories) — only with your submitted information Sending marketing updates only if you have opted in to receive them 4. SMS/Text Messaging Policy: Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. Message frequency varies. Any other mentions in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. If you wish to be removed from receiving future communications, you can opt out by texting STOP. Message & data rates may apply. 5. Data Sharing and Disclosure We do not sell or rent your personal information. We only share limited data with trusted partners who help us operate our business and deliver services, including: Acuity Scheduling – booking and appointment management Square – secure payment processing HubSpot – contact forms and client communications Sakari – SMS messaging and updates Pic-Time – client gallery hosting and delivery PhotoDay – online galleries and order delivery CloudSpot – legacy client galleries (transitioning out) Miller’s Professional Imaging – professional photo printing and fulfillment Framer / Wix – website hosting and analytics These providers process data only as necessary to perform their functions and are required to maintain confidentiality and security. 6. Cookies and Tracking Technologies Our websites may use cookies or similar tracking tools to analyze traffic, remember preferences, and improve performance. You can control or disable cookies through your browser settings. Disabling cookies may affect some site functionality. 7.
